Brian E. Geoghegan handles commercial transactions and civil litigation support for the firm. Brian’s approach to providing legal counsel begins with developing a core understanding of the fundamental business and personal objectives and values of the client. Within this larger context, he crafts legal strategies that can meet the client’s immediate and longer range needs, and works in collaboration with the client to choose a specific solution that both makes sound business sense and passes the gut-feel test. Brian then diligently applies the appropriate legal tools to reach that goal, always keeping his eyes and ears open to new information from within and without that might suggest a change of course.
Brian advises the firm’s clients on how to best protect and leverage their intellectual property, in light of their specific business objectives and unique circumstances. He is a registered patent attorney and has prepared and negotiated multi-party license agreements of patents, trademarks and copyright, filed for trademark and trade name protection at state and federal levels, customized non-disclosure agreements, and pursued remedies under the Digital Millennium Copyright Act. He has also drafted numerous contracts for a range of purposes including convertible debt, distribution and resale, term sheets, independent contractor agreements, and website terms of use and privacy policies.
Within the firm’s litigation practice, Brian applies his passion for white-board analysis and factual detail to visually map the various issues underlying a dispute, prior to pursuing potentially unnecessary legal research. He has applied this technique to help develop effective legal strategies for disputes among investors, claims against large government contractors, and forestalling foreclosure.Brian graduated from University of Colorado School of Law in 2008, where he earned the school’s first Certificate in Entrepreneurial Law, with honors. He received the 2007-2008 Outstanding Student Service Award for the Entrepreneurial Law Clinic and was Articles Editor for the Journal on Telecommunications and High Technology Law. Brian concentrated his studies on intellectual property, telecommunications, and technology law, and augmented his book learning with practical experience gained from clerkships with Sheridan Ross and Sun Microsystems, and an externship at CableLabs. Prior to law school, Brian managed various initiatives involving telecommunications, Internet, and e-commerce within the private, public, and non-profit sectors. Brian is licensed to practice law in Colorado, and is a registered patent attorney with the U.S. Patent and Trademark office.
